Sometimes, one spouse may be ordered to pay alimony or spousal support to the other spouse during or after a separation or divorce. According to Missouri Statutes 30-452-335, spousal support can be decided in a number of ways.
The court will consider the following factors when assessing the need for spousal support:
- The financial resources of the party in need of spousal support
- Time necessary to acquire sufficient education or training to become self-supporting
- The earning capacity of both parties
- The standard of living established during the marriage and prior to divorce
- The financial obligations of both spouses
- The length of the marriage
- The age, health, and condition of the receiving spouse
- The ability of the spouse to pay support
- The conduct of the parties during the marriage
Couples may have the opportunity to come to an agreement out of court that is specific to their own financial situation and family dynamic. If the couple cannot come to an agreement, however, the court will see fit make the decision on behalf of the couple.
